Straight answer
A 'near me' search mixes three very different kinds of seller. Here is how a smoke shop, a licensed dispensary and an online seller compare on law, paperwork and price, and what to check at each.

THCA flower near you comes from one of three places: a smoke or hemp shop that sells it as hemp, a licensed dispensary that sells it as cannabis, or an online seller that ships it. Which one is lawful where you live depends on your state, and as of Oct. 3, 2026 the hemp-shop lane is fully open in only five states.

Three kinds of “near me” result

State law is the first filter. As of Oct. 3, 2026, 24 states and Washington, D.C. have legal adult-use cannabis, though Virginia’s stores do not open until July 1, 2027 and D.C. has no adult-use retail. In most adult-use states the hemp lane for THCA flower is closed and the dispensary is the legal route. Missouri is the only state with both lanes open, and only until Nov. 12, 2026. State rules change often, so check your state’s current law before you order.
The smoke shop: what to check at the counter
You can see and smell the flower. That is the advantage. The paperwork is on you.
- Ask for the COA for the jar in front of you. The lot code on the jar or bag should match the report. A QR code on the shelf that opens a generic brand page is not a lot COA.
- Check total THC, not just delta-9. A hemp COA that shows only “delta-9 under 0.3%” in bold is hiding the number that matters after Dec. 11, 2026.
- Look for the contaminant panels. Pesticides, heavy metals, microbials and mycotoxins, not potency alone.
- Notice the age check. A shop that does not ask for ID is telling you how it handles other rules.
- Know your state’s retail rules. Some states regulate where hemp can be sold. Kentucky bans selling raw hemp flower to unlicensed persons, and West Virginia requires a per-location retail permit. Tennessee, enforcing from July 1, 2026, bans THCA products and allows other permitted hemp products only at 21+ licensed premises, with no online sales or home delivery to consumers.
The licensed dispensary: what is different
A licensed dispensary is part of a state system. The state licenses the store, sets testing rules and tracks product from plant to sale. You pay for that with higher prices, state cannabis taxes on top of sales tax in most adult-use states, and purchase limits per visit.
Check that a store is actually licensed before you treat it as one. California’s Department of Cannabis Control runs a License Search Tool that it says is updated daily and covers every business it licenses. Most adult-use states publish a similar list through their cannabis regulator.
One trap: in a state with no adult-use or medical program, a shop with “dispensary” on the sign is a hemp or smoke shop. The word is not a license. In a medical-only state, a medical dispensary serves registered patients with a card.
The online seller: what replaces walking in
You cannot look at the buds, so the seller has to show you more. Look for a COA per lot with matching lot codes, a named business with a phone and street address, and written policies for short weight, lost parcels and refunds. Our where to buy THCA flower guide walks through a ten-point check.
Shipping has its own rule. As of Oct. 3, 2026, USPS accepts hemp for domestic mail only when the shipper complies with federal, state and local law and keeps compliance records, including lab results, for at least 3 years after mailing (USPS Publication 52, section 453.37). An online seller being in a hemp-lane state does not make the flower lawful in yours.
How the three compare on price
Online sellers mostly price by the pound, which is why they look cheapest per gram. In public listings from 15 online sellers on Oct. 2, 2026, THCA flower ran about $0.22 to $3.53 a gram, from shake to exotic indoor (our price bands). Smoke shops usually sell grams to ounces, and small bags cost more per gram. Dispensary prices carry state cannabis taxes. Compare any of them the same way: price divided by grams, then check the COA.

After Dec. 11, 2026, the “near me” answer for high-THCA flower is a licensed dispensary in an adult-use state, unless Congress moves the date again. A smoke shop still selling high-THCA flower as hemp after that date is a red flag.

- Not necessarily. 'Dispensary' is a word on a sign. A licensed cannabis dispensary holds a state license you can look up with the state regulator, such as California's Department of Cannabis Control License Search Tool. In a state with no adult-use or medical program, a shop called a dispensary is a hemp or smoke shop.
- Is THCA flower from a smoke shop lab tested?
- Sometimes. Hemp shops are not part of a state cannabis testing system, so testing depends on the brand. Ask to see a COA for the lot in the jar, with a matching lot code, a test date and a full contaminant panel. A licensed dispensary's flower goes through the state's required testing.
- Can I buy THCA flower near me after December 11, 2026?
- Not as hemp, unless Congress changes the date. As of Oct. 3, 2026, federal law counts THCA toward the 0.3% total-THC hemp limit from Dec. 11, 2026. Licensed dispensaries in adult-use states are not affected by that hemp change and keep selling under state law.
